Why South Dakota Still Has No Recreational Cannabis

South Dakota voters approved Amendment A — a constitutional amendment legalizing recreational cannabis — in November 2020 with 54% of the vote. Governor Kristi Noem challenged the amendment in court, arguing it violated the state's single-subject rule for ballot measures. The South Dakota Supreme Court agreed and struck it down in 2021.

A follow-up initiative (Measure 27) went on the 2022 ballot and was defeated 53%–47%. South Dakota remains one of the last Great Plains states without recreational sales as of 2026, despite two separate voter-driven attempts to legalize.

The result: South Dakotans who use cannabis legally travel to neighboring states. Minnesota, which legalized in May 2023 and opened its first dispensaries in early 2025, is the closest option for most of the state.

Consume in Minnesota — then return home

This is the critical rule. All cannabis must be consumed before you cross back into South Dakota. No exceptions. Interstate transport is a federal crime regardless of the states involved.

Tribal Dispensaries: Skip the State Tax

Minnesota charges a 15% cannabis excise tax plus 6.875% state sales tax — roughly 22% added to every purchase. Dispensaries operated by sovereign tribal nations are exempt from these state taxes.

For South Dakota visitors coming for larger purchases, the savings can offset a slightly longer drive. The Lower Sioux Indian Community and Upper Sioux Community (Pejuhutazizi) both operate in southwest Minnesota, in the same general region as Pipestone and Luverne.
