In short: Delta-8 and delta-9 are both THC molecules. On one Diamond CBD gummy certificate, they appear together: 133.7 mg delta-8 and 9.061 mg delta-9 per unit, on a product titled 150 mg. Delta-9 is the THC Minnesota's hemp edible caps are written around. Delta-8 on that sheet is an order of magnitude larger. November 12, 2026 is not a blanket delta-8 ban. December 11, 2026 is the date for cannabinoids manufactured outside the plant and for containers over 0.4 mg.

Minnesota's delta-8 status page is delta-8 in Minnesota. Licensed delta-9 gummies are a different counter: delta-9 gummies.

How this page was checked

The Hub opened Diamond CBD's delta-8 gummies collection, delta-9 gummies collection, Chill Plus brand page, and the Chill Extreme 150 mg mixed-fruit gummy on October 29, 2026. The certificate image on that gummy was read. Federal dates come from the amendment note to 7 U.S.C. 1639o and section 2019 of enrolled H.R. 6500. Minnesota numbers come from sections 342.01 and 342.62 on the Revisor site the same day. No gummy was eaten.

Six differences

Point Delta-8 on the records read Delta-9 on the records read
On the Chill Extreme sheet 133.7 mg per unit, 3.164 mg/g, 0.32% 9.061 mg per unit, 0.214 mg/g, 0.02%
What the title said The page says 150 mg of a D8 and D9 gummy, not a split Same title. The split is only on the sheet
Minnesota hemp cap Not the cannabinoid named in the 5 mg and 50 mg delta-9 lines Section 342.01 and 342.62 are written as delta-9 THC
Federal November 12 Not the "cannot be made by the plant" clause by itself Same. Delta-9 is made by the plant
Federal December 11 Outside-the-plant manufacture, if that is how it was made, plus any similar-effects count Counts in total THC. 9 mg in one gummy is already over 0.4 mg
Seller's Chill Plus page Called a hemp-derived product and "the premier Delta-8 product" The delta-9 collection says the gummies include CBD "to balance out the buzz"

The Chill Plus brand page says delta-8 is made from hemp and calls the brand one of the safest on the market. Those are the seller's sentences. The certificate does not rank safety. Its pesticide and heavy-metal icons say not tested.

One certificate, two THC columns

The 150 mg D8 and D9 mixed-fruit gummy page says 150 mg per gummy, 30 gummies, 4,500 mg total. The price meta was $90. The certificate, sample ID "140mg D8+10mg D9," analysis date January 7, 2026, does not say 150 and does not say 140 plus 10 as the measured result. It says 133.7 mg delta-8 per unit and 9.061 mg delta-9 per unit. Total cannabinoids are 142.76 mg per unit. The sample name is closer to the result than the product title is. Delta-9 THCA, CBD, and THCP are not detected on that sheet.

A shopper who adds the two THC lines gets 142.761 mg, near the total-cannabinoid figure, not 150. The page's 150 mg is a round title. The sheet is the split.

A separate Chill Plus product, 50 mg delta-9 blueberry gummies, listed 50 mg per gummy, 10 gummies, 500 mg total, price meta $80. This guide did not find a certificate image in that page's HTML. A 50 mg delta-9 gummy is ten times the 5 mg Minnesota non-beverage serving line, before any package math. It is not quoted here as a lab result.

Where each molecule comes from, as far as the pages go

Delta-9 THC is the compound the older federal hemp definition measured, at 0.3% by dry weight. Diamond's where-we-ship page still uses that sentence. Delta-8 is described on the seller's delta-8 collection as a form of THC with a structure similar to delta-9. The Chill Plus page says the products are made from hemp. It does not print a step-by-step conversion. Commercial delta-8 is widely made by converting CBD. This guide will not assert that about a specific jar unless the jar's own page says it. These pages say "hemp" and "hemp-derived." They do not say "converted from CBD" in the lines that were read.

That gap matters on December 11, because the statute's outside-the-plant clause is about manufacture, not about the nickname on the jar.

The two federal dates

November 12, 2026: cannabinoids that are not capable of being naturally produced by the plant, under the slice of Public Law 119-37 that section 2019 of Public Law 119-103 leaves in effect until December 11. Delta-8 and delta-9 have both been reported from cannabis. This page does not put them in the "cannot be produced" box.

December 11, 2026: the rest, including outside-the-plant synthesis, and final products over 0.4 mg combined total per container of total THC including THCA plus similar-effect cannabinoids. One Chill Extreme gummy at 9.061 mg delta-9 is already over 0.4 mg before the 133.7 mg of delta-8 is considered. A 30-count jar multiplies that. The federal hemp timeline is the Minnesota office's version of the December 11 date.

Minnesota's delta-9 math, and what it does not count in the same sentence

Read October 29, 2026: section 342.01, subdivision 50, non-beverage servings no more than 5 mg delta-9 THC, beverage containers no more than 10 mg delta-9 THC. Section 342.62, subdivision 2(f), multi-serving non-beverage packages no more than 50 mg delta-9 THC. The Chill Extreme sheet's 9.061 mg delta-9 in one gummy is over 5 mg. Thirty units would be far over 50 mg if each piece matches that sheet. Delta-8 is additional. Minnesota also defines an artificially derived cannabinoid as one whose structure is changed after extraction with a catalyst other than heat or light, with a narrow exception when delta-9 is created and the ratio of delta-9 to other artificially derived cannabinoids is at least 20 to 1. On this sheet, delta-8 milligrams are much larger than delta-9 milligrams. That ratio runs the other way. This is a reading of the published numbers against the published definition, not an enforcement decision.

Licensed adult-use gummies are the other legal product. They are not this mail-order jar. Start at delta-9 gummies. The state's 15% cannabis excise tax on licensed cannabis is covered in the tax breakdown.

A beginner dose is not on this certificate

The seller's delta-8 collection says delta-8 gummies start slow and last long, and that people should be careful. It does not print a milligram chart that this guide will adopt. The sheet's 133.7 mg of delta-8 in one piece is not a beginner serving. The delta-9 collection says many gummies pair delta-9 with CBD and gives an example of 10 mg delta-9 and 10 mg CBD. That example is the seller's general copy. It is not the Chill Extreme sheet, which did not detect CBD.

Drug tests are not split neatly by the 8 and the 9. The drug test guide is the page for that risk. THCP, a third THC-class molecule, is in is THCP synthetic.

A second delta-9 number from the drink shelf

The same seller's mango seltzer, covered in the high-dose drinks article, has a certificate at 199.8 mg delta-9 per can and almost nothing else on the potency panel. The Chill Extreme gummy has 9.061 mg delta-9 and 133.7 mg delta-8 in one piece. Both are Diamond CBD products read the same day. One is a delta-9 drink with a title that matches the sheet. The other is a blend whose title, 150 mg, matches neither column exactly. If the question is "delta-8 versus delta-9," the useful comparison is those two public files, not a slogan about which molecule is milder.

Price meta was $90 for the 30-count Chill Extreme jar. If the sheet's 9.061 mg delta-9 is the figure you care about, the jar holds about 272 mg of delta-9 across 30 pieces, and $90 divided by 272 mg is about 33 cents per mg of delta-9, before the delta-8 is counted at all. The mango can was $9 for 199.8 mg of delta-9, about 4.5 cents per mg. This arithmetic is not a recommendation to buy the can. The can is illegal as a Minnesota lower-potency hemp beverage under the 10 mg cap. It is a way to see that "150 mg" on a gummy and "200 mg" on a can are not the same shopping problem.

The delta-8 collection also printed a recent review naming a 32.5 mg D8, D9, and THCP gummy. That review is a customer's note, dated in the snippet October 28, 2026. It is not a certificate and not a dose instruction. THCP's own date problem is on the THCP page.

Which one, if you are choosing

If you are in Minnesota, the hemp numbers that are actually in the statute are delta-9 numbers, and the gummy sheet above misses them. Licensed delta-9 products are the in-state path. If you are comparing molecules, read the two columns on one certificate instead of a potency slogan. Delta-8 was the larger line. Delta-9 was still 9 mg, which is not zero, and not 5.

After Dec 11, 2026

The Minnesota Office of Cannabis Management says a federal hemp definition change takes effect December 11, 2026, unless other federal action occurs. OCM describes that change as effectively banning hemp products that contain more than 0.4 mg of THC per package. Minnesota's lower-potency hemp edible rules do not change that day. Single product URLs go stale when an item is pulled. These category pages returned HTTP 200 on October 29, 2026. The aisle that matches this article is delta-8 gummies. The CBD aisles more likely to remain are CBD isolate gummies, CBD oils, pet CBD, and CBN gummies. Hub guides for those aisles: THC-free CBD oil, CBD dog treats, and THC-free sleep gummies.

FAQ

Is delta-8 weaker than delta-9 on this gummy's certificate?

The certificate does not measure "weaker." It measures milligrams. This piece had more delta-8 (133.7 mg) than delta-9 (9.061 mg). A larger milligram line is not a clinical potency ranking.

Is delta-8 synthetic?

The statute's December 11 clause covers cannabinoids that can occur in the plant and were synthesized or manufactured outside it. The Chill Plus page says hemp and does not describe a conversion. The certificate shows delta-8 in the sample. It does not show the reactor.

Will delta-8 fail a drug test?

This page does not promise a result. The same gummy also contains 9.061 mg of delta-9 on the sheet. Either line is a reason to read the drug test guide before a test, not after.

The November 12 exclusion left in place by section 2019 is for cannabinoids the plant cannot produce. The container cap and the outside-the-plant clause are December 11. This gummy is over 0.4 mg on the delta-9 line alone.

What is a careful first amount of the Chill Extreme gummy?

The sheet shows 133.7 mg delta-8 and 9.061 mg delta-9 in one unit. Minnesota's non-beverage hemp serving line is 5 mg of delta-9. This guide will not suggest a fraction of a gummy as a calculated legal serving. The numbers do not land on 5.
